Tutor Agreement
Version 0.3, last published 16 September 2026.
By registering as a tutor with Delta Tutoring, you agree to the following terms governing your engagement as an independent contractor providing tutoring services.
1. Services
You agree to provide academic tutoring to students matched to you through the Delta Tutoring platform, in the subject(s)/module(s) you register to teach. Session frequency and scheduling are agreed directly with each student and may be adjusted from time to time by mutual consent.
2. Term and Termination
This Agreement takes effect when you register and continues on an ongoing basis until terminated. You or Delta Tutoring may terminate at any time by providing at least 24 hours’ written notice. Delta Tutoring remains responsible for payment for all sessions completed, and any properly-noticed but cancelled sessions, up to the effective date of termination. Either party may terminate immediately for a material breach, non-payment, or conduct endangering the safety or well-being of a student or tutor.
3. Fees and Payment
Pay-as-you-Go sessions: you earn a flat R120/hour, regardless of your year of study or the student’s, off a R200/hour session rate — fixed platform-wide, not individually negotiated. Premium package sessions: your compensation rate for Premium package sessions will be confirmed separately before Premium bookings go live. Group session rates: R75 per student in the group, per session. You’re responsible for logging completed sessions by the last working day of each month; payment is processed via EFT within 5 business days of month end, using your Application ID as the payment reference. Payment queries: info@deltatutoring.co.za.
4. Cancellations and Rescheduling
Cancellations, postponements, and no-shows are governed by Delta Tutoring’s Cancellation Policy (linked at booking).
5. Materials and Preparation
Responsibility for providing textbooks, worksheets, or other learning materials is agreed between you and each student. You may recommend supplemental materials, the cost of which (if any) is borne by the student unless otherwise agreed.
6. Conduct and Professionalism
You agree to communicate respectfully, to promptly raise any concerns about conduct, progress, or scheduling through the designated communication channel, and to maintain any background check, certification, or licensure required by Delta Tutoring or by law.
7. Confidentiality and Protection of Personal Information
Personal, academic, or family information shared in the course of tutoring is kept confidential and used solely to provide tutoring services, in accordance with POPIA and Delta Tutoring’s Privacy Policy.
8. Independent Contractor Status
You render services as an independent contractor, not as an employee of Delta Tutoring. This Agreement does not constitute a contract of employment for purposes of the Basic Conditions of Employment Act 75 of 1997 or the Labour Relations Act 66 of 1995. You are responsible for your own tax affairs (including any obligations to SARS), insurance, and any applicable registration or licensing. Nothing in this Agreement creates a partnership, joint venture, or employment relationship.
9. Limitation of Liability
You will provide services in good faith and with reasonable skill and care, but Delta Tutoring makes no guarantee of specific academic outcomes on your behalf. Except in cases of gross negligence or wilful misconduct, liability under this Agreement is limited to the fees paid to you by Delta Tutoring in the three (3) months preceding a claim.
10. Governing Law
This Agreement is governed by the laws of the Republic of South Africa, with disputes subject to the jurisdiction of the Magistrate’s Court, without prejudice to either party’s right to approach the High Court of South Africa.
11. Changes to this Agreement
Delta Tutoring may update this Agreement from time to time. Where a material change is made, you’ll be asked to re-confirm your acceptance.
